Liability in Arizona Construction Accidents

In Arizona, employers must provide and maintain a safe workplace. They must recognize and address safety hazards that may exist in the workplace and they must work to prevent potential hazardous situations. One way employers can lessen the chances of a serious injury accident is to provide proper safety training and safety equipment.

Construction continues to be one of the most dangerous fields of work nationwide. There is often the chance of suffering a serious falling accident, receiving an electrical shock, or being hit by falling debris. Dangerous heavy machinery accidents and defective scaffolding incidents can also cause serious injury. Companies that fail to provide proper safety devices and equipment may face serious fines from the Occupational Health and Safety Administration (OSHA).

OSHA has a number of standards that must be met to avoid agency citations. Among the most common Arizona OSHA violations are failure to provide proper evacuation plans, head protection, hazard communication and fall protection. When a company fails to provide adequate safety devices such as hard hats, protective eyewear and safety harnesses, there is the potential for serious injuries or even fatalities.

Following most accidents, injured Arizona construction workers may not sue their employer. Instead, they must pursue financial compensation through their employer's workers compensation insurance. Losses that may be covered by workers compensation benefits include a portion of the wages lost during the recovery process, hospital bills and disability coverage.

Construction Worker Injured while Working at Tempe's Diablo Stadium

An Arizona man was injured in a Tempe construction accident as he worked with a crane. According to an ABC 15 news report, the recent injury accident occurred at the Tempe Diablo Stadium near 48th Street and Broadway Road. A 10-ton piece of equipment struck the 30-year-old worker as he worked on top of a crane. The man suffered a broken leg in the Arizona crane accident. An investigation is ongoing.

According to the Electronic Library of Construction Occupational Safety and Health (eLCOSH), 54 construction workers were killed and 100 were injured in crane accidents throughout the United States in the year 2008. Also, 39 percent of crane accidents involved crane collapse and 14 percent of crane injury accidents involved a worker being struck by a crane load.

Construction workers injured in Arizona crane accidents may file for workers compensation benefits to cover their hospital expenses and a portion of the wages they lose while missing work. If the crane accident was the result of someone else's negligence or due to poor maintenance or a defective part, it is possible that additional compensation may be available through a third party claim. A thorough investigation will be required in such cases to establish the cause of the crane accident and in order to determine who should be held liable for the worker's injuries.
